Terms of service for Lumitra Mail

Version of 2026-10-28.

These terms govern the use of Lumitra Mail (mail.lumitra.co and app.mail.lumitra.co, its API and SDK) between Marlin Jai Pohl, trading as Lumitra, Grumbkowstr. 6, 13156 Berlin, Germany ("Lumitra"), and the business that uses it (the "customer"). The processing agreement at mail.lumitra.co/processing-agreement is part of them. The customer accepts both when it creates a workspace and again when it buys a paid plan.

1. Who may use Lumitra Mail

Lumitra Mail is offered to businesses only: companies, organisations and self-employed people acting in their trade or profession (entrepreneurs in the sense of section 14 of the German Civil Code). By accepting these terms the customer confirms that it uses the service for that purpose. Consumers cannot conclude a contract.

The customer's own general terms do not apply, even if Lumitra does not object to them.

2. The service

Lumitra Mail lets the customer keep contacts and their subscriptions, design email, send it through a mail provider the customer connects or, on a plan that includes it, through Lumitra from the customer's own domain, run automations, and offer unsubscribe, preference and sign-up pages. What a plan includes (messages a month, contacts, members, providers, own domains and features) is shown on the Billing page of the workspace and on mail.lumitra.co.

Lumitra develops the service further and may change features, as long as the main purpose of the plan the customer pays for is kept. Lumitra aims for high availability but promises none; maintenance is announced in advance where possible.

3. Account, workspaces and members

The customer signs in with an account at auth.lumitra.co and keeps its credentials, API keys and members' access confidential. The customer is responsible for what is done with its workspace, its API keys and the accounts of the members it invites.

4. What the customer must observe when sending

The customer sends only email it may lawfully send: to recipients who consented where the law requires it (in Germany in particular under section 7 of the Act against Unfair Competition and the GDPR), with its own correct identity as the sender, with a working way to unsubscribe, and without content that is unlawful, deceptive, infringing or harmful.

The customer may not use the service for unsolicited bulk mail, purchased or rented address lists, phishing or malware, or to evade the limits of a plan.

The service pauses a provider on its own when its bounces or complaints pass a threshold; the reason shows in the dashboard, and the customer resumes sending once the cause is resolved. Lumitra may also pause sending or a workspace without notice where this is needed to stop a breach of these duties or a risk to the service or to other customers' deliverability; it then tells the customer why and lifts the pause once the cause is resolved.

The customer holds Lumitra harmless from third-party claims that arise from a breach of this section for which the customer is responsible, including reasonable costs of legal defence.

5. Own domains and domains bought in Lumitra Mail

A customer that sends through Lumitra from its own domain confirms that it is entitled to use that domain. Lumitra registers the domain with its sending provider (Resend, in its EU region) and, where the domain's DNS is managed in Lumitra's Cloudflare account for the customer, writes the required DNS records itself; otherwise the customer sets them. Removing the domain removes it at the sending provider and deletes the records Lumitra wrote.

A customer on a paid plan can buy a domain inside Lumitra Mail. The price per year is shown before paying: the registry's price converted at the European Central Bank's reference rate and rounded up to the next euro, plus 5 euros, for the first year and for every renewal. Lumitra registers the domain only once the first year is paid, in the customer's name: the customer (with the holder details it enters) is the domain's holder, Lumitra registers it on the customer's behalf through its registrar (Cloudflare) and manages its DNS in Lumitra's Cloudflare account. If the registry refuses the domain after payment, Lumitra refunds the payment in full. A registration that went through cannot be refunded.

The domain stays the customer's. The customer can move it to any other registrar at any time, free of charge from Lumitra; Lumitra provides the transfer code on request. Cancelling a paid plan, deleting a workspace or erasing the customer's account never deletes a bought domain: its owners receive the transfer code first, and the domain runs until the end of the year already paid. Lumitra renews it at the price shown and charges the renewal before it is due; if the renewal is not paid, the domain is not renewed and its owners are told before it lapses.

6. Prices and payment

The Free plan costs nothing. Paid plans and add-ons (such as further own domains) are billed monthly in advance at the price shown when they are bought, through Stripe, to the payment method the customer provides. Prices are final prices: as a small business under section 19 of the German VAT Act, Lumitra charges no VAT and shows none on its invoices. Should Lumitra become obliged to charge VAT, the prices become net prices and VAT is added at the statutory rate, announced six weeks in advance.

A change of plan or of an add-on takes effect at once and is charged or credited pro rata for the rest of the period. If a payment fails, Stripe tries it again and tells the customer, and the plan stays in place meanwhile; if the subscription then ends for want of payment, the workspace continues with the Free plan's limits. Nothing the customer stored is deleted for that reason.

Lumitra may change prices for a coming period by telling the customer at least six weeks in advance; the customer may then cancel before the change takes effect.

7. Term and termination

A paid plan runs month by month. The customer can cancel it at any time in the billing portal, effective at the end of the period already paid; the workspace then continues on the Free plan. The customer can delete its account at auth.lumitra.co at any time, which erases every workspace of its company, or ask Lumitra to delete a single workspace.

Lumitra can end a paid plan with six weeks' notice to the end of a period, and either party can terminate for good cause without notice, in particular for a serious breach of section 4.

Until a workspace is deleted the customer can retrieve its data through the API (its contacts, templates, mailings and their recipients) and export its templates and mailings. What happens to the data afterwards is set out in the processing agreement.

8. Data protection

Lumitra processes the personal data of the customer's recipients on the customer's behalf, under the processing agreement at mail.lumitra.co/processing-agreement, which the customer accepts with these terms. The privacy notice at mail.lumitra.co/privacy describes what is processed. The customer remains responsible for the lawfulness of the processing it instructs.

9. Liability

Lumitra is liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act, and where it gave a guarantee.

For slight negligence Lumitra is liable only for the breach of an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance the customer may regularly rely (a cardinal obligation), and then limited to the damage typical and foreseeable when the contract was concluded. Otherwise liability for slight negligence is excluded. On the Free plan, liability for slight negligence is excluded altogether, except for injury to life, body or health.

Lumitra is not liable for the delivery decisions of receiving mail servers or of the mail provider the customer connects.

10. Changes and notices

Lumitra announces a change of these terms or of the processing agreement at least six weeks in advance. A change that is not solely to the customer's advantage applies to the customer only once the customer accepts it in the dashboard; until then the previous version applies, and if the customer does not accept, Lumitra may end a paid plan as of the date the change was to apply. Whoever creates a workspace or buys a paid plan accepts the version current at that time.

Notices to the customer go by email to the owners of its workspaces. Notices to Lumitra go to the address in the imprint.

11. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If the customer is a merchant, a legal entity under public law or has no general place of jurisdiction in Germany, the place of jurisdiction is Berlin. Should a provision be invalid, the rest remains in force. The German version of these terms is binding; the English version is a translation.
